Terms of Service for Commission Work
Please read my terms of service in full before commissioning me. By commissioning me, you are agreeing to the terms laid out below.
I. GENERAL TERMS
-
All commissions are accepted at my discretion. I reserve the right to refuse to accept a commission on any grounds should I see fit to do so.
-
If a client (the person commissioning the artwork) fails to abide by the terms of service specified here, I reserve the right to cancel the commission transaction at any time.
-
Abusive or disrespectful conduct from a client will not be tolerated under any circumstances and may result in the commission transaction being cancelled.
II. PERSONAL USE VS. COMMERCIAL USE
-
‘Personal use’ refers to a commission that is intended for the private, non-commercial (i.e. not making money from it) use of a client. ‘Personal use’ includes:
- Posting the commissioned artwork online and on social media channels (with appropriate artist credit)
- Printing the artwork as the client sees fit
- Displaying the artwork as the client sees fit
- Commissioning the artwork as a gift for someone else
- Using the artwork as a character avatar or reference piece (with appropriate artist credit)
Artist credit must always be given where possible. Clients must not claim the artwork as their own.
The sale, commercial use or mass distribution of any material featuring or derived from the artwork is not permitted under any circumstance. -
Unless the client holds an officially granted license to distribute and profit from a third-party IP (i.e. a character or intellectual property that the client themselves does not own), ALL fanart commissions will fall under the ‘personal use’ category.
-
‘Commercial use’ refers to a commission that is intended for marketing purposes and for-profit (i.e. money-making) use. This would include but is not limited to use of the artwork or material derived from the artwork:
- On merchandise of any kind
- In film, TV or streamed shows
- For-profit publications and printed material
- Commercial advertisements or promotions
In the instance of commercial-use commissions, I retain full rights to the artwork in question for both personal and commercial use, and reserve the right to include the artwork in my portfolio as well as posting it online and to my social media channels. Artist credit must still be given for commercial use commissions, and clients must not claim the artwork as their own.
III. PAYMENT & FEES
-
Payments are accepted in GBP, USD and EUR only.
-
Payment can made via receipt of a Paypal invoice, by wire transfer or by Zettle payment link.
-
The final fee for a commission—based on the brief agreed upon prior to work commencing on the commission—will be due up front and in full. For commissions costing $500 or more, the option to pay in installments can be discussed.
-
Payment will only be requested and taken once I am ready to start work on a commission.
-
Excessive or major amendments, deviations, additions or changes to the original brief given by the client may incur additional fees appropriate to the changes in question and at my discretion.
IV. REFERENCE MATERIAL
-
Clients are free and welcome to supply visual references when discussing and finalising the brief for their commission.
-
Clients are free to supply visual references via any means they wish, but a link or share invite to a curated Google Drive folder is preferred.
-
Please note that supplied reference material will never be copied directly in a way which either infringes upon someone else’s work or intellectual property.
V. COMMISSION PROCESS
-
Work on a commission will only begin once payment has been received in full, or, in the case of a pre-agreed payment plan, once the first installment of a payment has been received.
-
Clients will be sent progress previews of their commissions for their approval at 2–6 separate stages:
- Sketch
- Lineart and flat colours (this will be the final version if commission is flats-&-highlights only)
- Final artwork (if commission is fully shaded)
More complex commissions, e.g. a full D&D party or an illustration commission, may have between 3–6 approval stages to reflect the nature of the commission. -
Margin for minor edits or adjustments to be made within reason and at the appropriate stage is reflected in commission prices. Work on a commission will pause until a client has given their feedback and/or approval at each stage, at which point work will progress to the next approval stage.
-
‘Within reason and at the appropriate stage’ refers to minor edits or adjustments to the artwork, as requested by the client at feedback/approval stages, which do not deviate from the original agreed-upon artwork brief and are requested at a point during the commission’s progress where they are easy to implement. For example:
- Requesting the amendment of a hand position once at sketch stage.
- Requesting the adjustment of a single garment’s colour at the lineart and flat colours stage.
- Requesting the adjustment of a character’s nose shape at the sketch OR lineart and flat colours stage.
It is the client’s responsibility to provide an accurate, detailed brief for their commission before work on the commission begins. -
Excessive edits or adjustments, edits or adjustments to WIP artwork already approved by the client, or major edits or changes which deviate from the original agreed-upon artwork brief will incur extra fees at my discretion in line with the edits, adjustments or changes requested. For example:
- Requesting the amendment of a hand position three or more times would be considered excessive edits.
- Requesting that a character’s expression be amended AFTER the sketch has already been approved would be considered an edit to WIP artwork already approved by the client.
- Requesting the colour of a character’s hair be made darker AFTER lineart and flat colours have already been approved would be considered an edit to WIP artwork already approved by the client.
- Requesting a character’s pose be changed from the one originally specified would be considered a major change. -
Commissions will completed within 30 working days from receipt of payment or, in the case of a pre-agreed payment plan, from receipt of the first installment.
-
I am able to work to rush deadlines within reason and at my discretion, but these will incur extra fees. Please be aware that rush-deadline commissions cannot be turned around in anything less than 10 working days.
-
In the event that any delay or issue regarding the commission should occur on my part, clients will be notified immediately.
-
After the final artwork for the commission has been approved by the client, they will be sent a high resolution (300dpi) version of the commission in both RGB and printable CMYK format.
-
Please note that I do not supply layered PSD-format versions of artwork except in specific, commercial-use instances. If you have any specific file format requirements (e.g. TIFF format, transparent-background PNG format), please let me know in advance when we discuss the details of your commission.
VI. COPYRIGHT
-
I, the artist, retain the right be identified and credited as the artist of the commission and reserve the right to include the artwork in my portfolio. I may also post the artwork online and to my social media channels with the client’s consent.
-
If you wish to discuss a commercial-use license for artwork that was commissioned by you which is currently licensed for personal use only, please contact me.
-
Artwork may be commissioned under the terms of an exclusive license; specific terms are subject to contract and may vary on a case-by-case basis. If you wish to discuss an exclusive rights commission, or purchasing the exclusive rights to artwork that was commissioned by you for either personal or commercial use, please contact me.
-
Please note that under no circumstances will I create artwork nor license my artwork for the purposes or creation of NFTs, nor is use of my work for the purposes or creation of NFTs permitted.
-
Please note that use of my work to train AI programmes (including transformers and large language models) is not permitted.
-
Please note that unauthorized editing or manipulation of my work is not permitted, except for those protected under Fair Use.
-
Any unauthorized sale or distribution of my work is not permitted.
VII. CANCELLATION/REFUND POLICY
-
The client cannot cancel or demand a refund from me, the artist, under any circumstances once work on their commission has commenced.
-
The client may cancel a commission or commission slot if payment has not yet been sent.
-
Clients on my waiting list may ask to be removed at any time by contacting me.
If you have any questions or concerns, please don't hesitate to contact me.
